This License Agreement (the "Agreement") is an agreement between BuzzShield and you or the entity you represent ("Customer" or "you"). This Agreement takes effect when you sign BuzzShield Service Order or when you access or use any component of BuzzShield System, as applicable (the "Effective Date").
1. Grant of License
During the term of this Agreement, BuzzShield grants the Customer a limited license (with no right to sublicense, unless confirmed in writing) to access and use the System for the Purpose.
BuzzShield reserves any and all rights not expressly granted in this Agreement, including, without limitation, any and all rights to the System.
2. Warranties, Representations and Undertaking by the Customer
- Not use the System intentionally in violation of applicable law or regulations or any third-party rights (including intellectual property rights), or for governmental uses.
- Not use the license to the System granted herein to distribute malicious software or engage in unlawful activities.
- Be solely responsible for any Third-Party Content accessed using the System and ensure compliance with applicable laws and third-party rights.
- Indemnify BuzzShield against any claims arising from the use of the System.
3. Payment and Consideration
- You are required to provide BuzzShield with all necessary co-operation in relation to this Agreement and all necessary information as may be required by BuzzShield for your account, including personal and access related information as well as payment information, in each case, to enable BuzzShield to provide the requested service and to allow your use of the System. You assume full responsibility that such information is current, complete and accurate. You warrant that information that you provide to us will be truthful, accurate, and complete, and that you are authorized to provide such information.
- If your billing information and payment source is invalid, if charges billed to you are declined or not paid or if you fail to pay charges for a paid version of BuzzShield's services when due, your account may be downgraded, suspended or cancelled, at BuzzShield's discretion.
- Prices for the BuzzShield services are stated on BuzzShield's website and may change from time to time at BuzzShield's sole discretion. Prices are net of any withholding or other taxes and the Customer shall be responsible for payment of all such applicable taxes, levies, or duties.
- Please be informed that in order to comply with anti-money laundering (AML) standards, your transaction will undergo a verification process. If the cryptocurrency you have sent is associated with high risk or originates from illegitimate sources, we reserve the right to conduct additional identity verification. Kindly note that transactions from exchanges under sanctions (such as Garantex, Hydra Market, Tornado Cash, and others) as well as transactions from Iranian exchanges (such as Nobitex.ir, arzpaya.com, abantether.com) will be subject to delay and freezing by our AML department. Consequently, proxy usage services are temporarily suspended. Failure to provide the necessary information will result in the suspension of our services.
- BuzzShield's order process may be conducted and handled by online reseller/s. We currently operate with Any.money. Any.money is the Merchant of Record for all our orders. Any.money provides customers with service inquiries and handles returns. Customers' relationship with Any.money is governed by the following Terms and Conditions: Checkout Buyer Terms | Any.money and Privacy Policy: Privacy policy | Any.money.
4. Suspension
BuzzShield may suspend Customer's right to access or use the System if it determines that the Customer's use poses a security risk, may adversely impact the System, or is in breach of this Agreement, including if Customer is violating its payment obligations.
5. Disclosure of Information
BuzzShield shall have the right, but not the obligation, to monitor Customer's use of the System for billing purposes and to verify no misuse or network abuse. BuzzShield may share the Customer's relevant information with any authority in case of a complaint, lawsuit or demand, if BuzzShield determines that it is necessary to comply with law, regulation, subpoena or court order.
6. Term and Termination
This Agreement commences on the Effective Date and shall continue until terminated in accordance with the terms of this Agreement.
- Either party may terminate this Agreement at any time by providing the other party with a written notice of termination. The termination will take effect at the end of the calendar month in which the notice is received.
- BuzzShield reserves the right to terminate this Agreement immediately, without notice, if the Customer breaches any terms of this Agreement, engages in unlawful activities, or if BuzzShield determines that the Customer's actions pose a risk to the System or other users.
- Upon termination of this Agreement, the Customer shall immediately cease all use of the System and any outstanding payments shall become due and payable.
- Termination of this Agreement shall not affect any rights or obligations of the parties that have accrued prior to the date of termination.
- BuzzShield shall not be liable to the Customer or any third party for any damages or losses resulting from the termination of this Agreement.
7. Disclaimer of Warranties
BuzzShield provides the System on an "as is" and "as available" basis and disclaims any warranties of merchantability, suitability, or fitness for a particular purpose. BuzzShield does not warrant that the System will meet your requirements or that the operation of the System will be uninterrupted or error-free.
BuzzShield makes no representations or warranties of any kind, express or implied, as to the operation of the System or the information, content, materials, or products included on the System. You expressly agree that your use of the System is at your sole risk.
To the fullest extent permissible by applicable law, BuzzShield disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. BuzzShield does not warrant that the System, its servers, or e-mails sent from BuzzShield are free of viruses or other harmful components. BuzzShield will not be liable for any damages of any kind arising from the use of the System, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
